These Terms and Conditions govern the use of the Geartha website and the repair and restoration services offered by Geartha at 315/7 Mittraphap Road, Nai Mueang, Mueang Khon Kaen, Khon Kaen 40000, Thailand. By accessing this website or using our services, you agree to these terms.
1. Definitions
- "Geartha" refers to the watchmaker workshop operating at the address above.
- "Service" refers to any watch repair, cleaning, regulation, or restoration work carried out by Geartha.
- "Client" refers to any individual who brings a watch for service or submits an enquiry through the website.
- "Agreement" means the scope of work agreed between Geartha and the client at the point of intake.
- "Website" refers to the site accessible at geartha.blog.
2. Acceptance of Terms
By submitting an enquiry form on this website or leaving a watch for service, you confirm that you are at least 18 years old, have the legal capacity to enter into an agreement, and accept these Terms and Conditions in full.
3. Service Description
Geartha provides three primary services: water-resistance check and reseal, movement cleaning and regulation, and case refinishing and rebuild. Service availability is subject to the condition of the piece and our assessment at intake. We reserve the right to decline a job if it falls outside our capability, and we will state so clearly.
4. Intake and Scope Agreement
- Every watch is inspected before a quote is provided. A written account of findings is given to the client before work is agreed.
- The agreed scope is documented at intake. Work beyond that scope requires the client's explicit agreement before proceeding.
- A reference number is assigned to each watch on intake. A receipt is issued listing the piece description and agreed scope.
- The watch remains on Geartha's premises throughout the job. It will not be transferred to a third party without the client's consent.
5. Pricing and Payment
- Service prices are listed on the website in Thai Baht (฿) and represent the standard scope as described.
- Any additional work identified during the job is discussed and agreed separately. It will not appear on the final invoice without prior sign-off.
- Payment is due on collection of the watch.
- Accepted payment methods are communicated at intake.
6. Timelines
Estimated turnaround times are provided at intake. These are estimates based on current workload and the condition of the piece. If the timeline changes, the client will be notified before the original estimated collection date. Geartha is not liable for losses arising from service delays.
7. Parts and Materials
- Replacement parts (gaskets, crystals, lubricants) will be sourced to suit the watch's specification. Any non-standard sourcing decision is discussed with the client before ordering.
- Replaced components are kept until the client collects the watch. They may be inspected on request.
- Geartha does not use counterfeit or misrepresented parts.
8. Client Responsibilities
- Clients are responsible for providing accurate information about the watch at intake.
- Clients must collect the watch within 30 days of notification that the service is complete. After 90 days without collection or communication, Geartha reserves the right to treat the piece as unclaimed.
- Any watch brought in for service should be the client's own property or one they are authorised to bring in for repair.
9. Disclaimers
Geartha provides repair and restoration services on a best-efforts basis. We do not represent that any service will result in a specific level of performance or that a watch will function identically to its original specification after servicing, particularly for aged or extensively worn pieces.
Water-resistance ratings indicate performance under test conditions. Geartha is not responsible for water ingress in circumstances beyond the tested pressure specification.
Dent removal during case refinishing is carried out where structurally feasible. We do not represent that all dents or damage can be fully removed.
10. Limitation of Liability
To the extent permitted by Thai law, Geartha's liability for any claim arising from a service is limited to the value of the service fee paid. We are not liable for indirect, consequential, or incidental losses.
In the unlikely event of damage to a watch while in our care, liability is limited to the assessed market value of the piece at the time of intake, and does not extend to sentimental value or loss of use.
11. Intellectual Property
All content on this website — text, images, layout, and design — is the property of Geartha or used with permission. It may not be reproduced without prior written consent.
12. Termination
Either party may cancel an agreed service before work has commenced, with no charge. Once work has begun, Geartha may invoice for the proportion of work completed if the client withdraws.
13. Dispute Resolution
In the event of a dispute, we ask that the client contacts us directly first at [email protected] to attempt informal resolution. If unresolved, disputes are subject to the jurisdiction of the courts of Khon Kaen Province, Thailand, under applicable Thai law.
14. Changes to These Terms
These Terms may be updated from time to time. The current version will be published on this page. Continued use of the website or services after changes are published constitutes acceptance of the revised terms.
